OPEN PUBLIC MEETINGS ACT NOTICE

The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Brick Township Board of Education has caused notice of this meeting to be posted on the Administration Office Bulletin Board, the official District website and Channel BTV-20, and sent to the Asbury Park Press, the Brick Times, the Star Ledger and Municipal Clerk's Office.

OPERATIONS - The Interim Superintendent recommends that the Board approve the following items.

  1. To approve a Resolution to withdraw funds from Capital Reserve for the purpose of supporting the Brick Township High School East Parking Lot Project, as follows:
    WHEREAS, 
    the Brick Township Board of Education has established a Capital Reserve fund in accordance with N.J.S.A. 18A:21-2, and
    WHEREAS, in accordance with N.J.S.A. 18A:21-2 and N.J.A.C. 6A:23A-14.1(L2) the Board of Education may transfer funds to fund facilities projects as determined in accordance with N.J.A.C. 6A: 26-3, and
    WHEREAS, the Brick Township High School East Parking Lot is in need of repair.
    NOW THEREFORE BE IT RESOLVED that the Brick Township Board of Education authorizes the transfer of $529,503 from its Capital Reserve Account to support the Brick Township High School East Parking Lot project.


  2. To approve a Non-Fair and Open Resolution for a provider of Civil Engineering Services for the Brick Township High School East Parking Lot project, as follows:
    WHEREAS,
    there exists a need for Civil Engineering Services; and:
    WHEREAS, on March 9, 2017 CHA Consultants was approved to provide Civil Engineering Services for the Brick Township High School East Parking Lot project through the bidding process in the amount of $50,428.88; and
    WHEREAS, on June 22, 2017 the bids were opened and reviewed; and
    WHEREAS, the recommendation of the project award will be made on June 26, 2017; and
    WHEREAS, N.J.S.A. 18A:18A-5 et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Brick Township Board of Education by resolution at a public meeting; and
    WHEREAS, N.J.S.A. 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once, in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract, and that the resolution and contract are on file and available for public inspection in the Office of the Board of Education; and
    WHEREAS, N.J.A.C. 6A:23-A-5.2 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.
    NOW THEREFORE BE IT RESOLVED, by the Brick Township Board of Education, as follows:
    1. That CHA Consultants be and is hereby appointed by the Brick Township Board of Education to said position.
    2. This appointment is made without competitive bidding as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional licensed and regulated by law and as a Non-Fair and Open contract in accordance with N.J.S.A. 19A:44A-20.26.
    3. The fee for services shall not exceed $25,214.44, as per attached proposal:
    BTHS EAST PARKING LOT PROPOSAL
    4. The duration of this appointment shall be for twelve months from this date.
    5. A copy of this resolution shall be published in the Asbury Park Press required by law within twenty days after its passage.
    6. A certified copy of the resolution together with a copy of the proposal shall remain on file and be available for inspection.




  3. To approve a Non-Fair and Open Resolution for a provider of Civil Engineering Services for the Veterans Memorial Parking Lot project, as follows:
    WHEREAS, 
    there exists a need for Civil Engineering Services; and:

    WHEREAS, on June 22, 2017 the bids were opened and reviewed; and
    WHEREAS, the recommendation of the project award will be made on June 26, 2017; and
    WHEREAS, N.J.S.A. 18A:18A-5 et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Brick Township Board of Education by resolution at a public meeting; and
    WHEREAS, N.J.S.A. 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once, in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract, and that the resolution and contract are on file and available for public inspection in the Office of the Board of Education; and
    WHEREAS, N.J.A.C. 6A:23-A-5.2 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.
    NOW THEREFORE BE IT RESOLVED, by the Brick Township Board of Education, as follows:
    1. That CHA Consultants be and is hereby appointed by the Brick Township Board of Education to said position.
    2. This appointment is made without competitive bidding as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional licensed and regulated by law and as a Non-Fair and Open contract in accordance with N.J.S.A. 19A:44A-20.26.
    3. The fee for services shall not exceed $40,738.36, as per attached proposal:
    VETERANS MEMORIAL PARKING LOT PROPOSAL
    4. The duration of this appointment shall be for twelve months from this date.
    5. A copy of this resolution shall be published in the Asbury Park Press required by law within twenty days after its passage.
    6. A certified copy of the resolution together with a copy of the proposal shall remain on file and be available for inspection.
      


  4. To approve a Non-Fair and Open Resolution for a provider of Architectural Services for the Warren H. Wolf Elementary School Roof project, as follows:
    WHEREAS, 
    there exists a need for Architectural Services; and:
    WHEREAS, on March 9, 2017 Netta Architects were approved to provide Architectural Services for the Warren H. Wolf Elementary School Roof project through the bidding process in the amount of $81,000; and
    WHEREAS, on June 1, 2017 the bids for the project were awarded by the Board; and
    WHEREAS, N.J.S.A. 18A:18A-5 et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Brick Township Board of Education by resolution at a public meeting; and
    WHEREAS, N.J.S.A. 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once, in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract, and that the resolution and contract are on file and available for public inspection in the Office of the Board of Education; and

This appointment is made without competitive bidding as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional licensed and regulated by law and as a Non-Fair and Open contract in accordance with N.J.S.A. 19A:44A-20.26.
    3. The fee for services shall not exceed $27,000, as per attached proposal:
    WARREN H. WOLF ELEMENTARY SCHOOL ROOF PROPOSAL
    4. The duration of this appointment shall be for twelve months from this date.
    5. A copy of this resolution shall be published in the Asbury Park Press required by law within twenty days after its passage.
    6. A certified copy of the resolution together with a copy of the proposal shall remain on file and be available for inspection.


  5. To approve a Non-Fair and Open Resolution for a provider of Architectural Services for the Brick Township High School Track project, as follows:
    WHEREAS, 
    there exists a need for Architectural Services; and:
    WHEREAS, on March 9, 2017 Netta Architects were approved to provide Architectural Services for the Brick Township High School Track Project through the bidding process in the amount of $84,375; and
    WHEREAS, on June 1, 2017 the bids for the project were awarded by the Board; and
    WHEREAS, N.J.S.A. 18A:18A-5 et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Brick Township Board of Education by resolution at a public meeting; and
    WHEREAS, N.J.S.A. 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once, in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract, and that the resolution and contract are on file and available for public inspection in the Office of the Board of Education; and
    WHEREAS, N.J.A.C. 6A:23-A-5.2 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.

This appointment is made without competitive bidding as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional licensed and regulated by law and as a Non-Fair and Open contract in accordance with N.J.S.A. 19A:44A-20.26.
    3. The fee for services shall not exceed $28,125, as per attached proposal:

    4. The duration of this appointment shall be for twelve months from this date.
    5. A copy of this resolution shall be published in the Asbury Park Press required by law within twenty days after its passage.
    6. A certified copy of the resolution together with a copy of the proposal shall remain on file and be available for inspection.




  6. To approve a Resolution to award the bid for the Veterans Memorial Parking Lot Improvement Project, as follows:
    WHEREAS,
    the bids were opened and reviewed on June 22, 2017, as attached:

  9. To approve a Resolution for Property and Casualty Insurance Brokerage Services (excluding workers compensation), as follows:
    WHEREAS, there exists a need for a provider of Property and Casualty Insurance Brokerage Services (excluding workers compensation), and
    WHEREAS, this appointment is awarded as an Extraordinary Unspecifiable Service in accordance with the provisions of N.J.S.A. 18A:18A-5(2) as the services to be performed are specialized and qualitative in nature and require significant training and expertise in the field, and
    NOW THEREFORE BE IT RESOLVED by the Brick Township Board of Education, as follows:
    1. That Boynton and Boynton, in accordance with their Competitive Contract response dated June 12, 2017, be and is hereby appointed by the Brick Township Board of Education to said position.
    2. The fee for services shall not exceed the flat fee of $38,959 to be paid to the Broker by the carrier NJSIG as part of the Board Approved premium.
    3. A copy of the Resolution shall be published in the Asbury Park Press as required by law within twenty (20) days after its passage.
    4. A certified copy of the Resolution together with a copy of the proposal shall remain on file and be available for inspection.
    5. The duration of this appointment shall be from July 1, 2017 through June 30, 2018


  10. To approve submission of the Individuals with Disabilities Education Act - Part B Application for Fiscal Year 2018 and accept the grant award of the funds upon subsequent approval to the Fiscal Year 2018 IDEA-B Application, as follows:

HUMAN RESOURCES - The Interim Superintendent recommends that the Board approve the following items.

  1. To ratify and continue the suspension of the District Superintendent without pay (effective 9/29/15) pending disposition of the criminal charges set forth in an indictment handed up by an Ocean County Grand Jury on 9/29/15 (with Subsequent Indictment for said acts/omissions filed 6/21 /17), pursuant to N.J.S.A. 18A:6-8.3 or until further action by the Board.  

  2. To approve Dennis Filippone as Acting Superintendent for the 17-18 SY with an additional salary of $44.13 per diem effective 7/1/17.

  3. To approve Thomas Gialanella as Interim Director of Planning, Research, and Evaluation for the 17-18 SY effective 7/1/17 at a rate of $638.56 per diem expected to work two days per week.
