The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Brick Township Board of Education has caused notice of this meeting to be posted on the Administration Office Bulletin Board, the official District website and Channel BTV-20, and sent to the Asbury Park Press, the Brick Times, the Star Ledger and Municipal Clerk's Office.

PRESENTATIONS

2018-2019 BUDGET PRESENTATION AND OVERVIEW OF PROPOSED REFERENDUM

CURRICULUM AND INSTRUCTION - The Acting Superintendent recommends that the Board approve the following items.

To approve submission of the District Improvement Plan as required by QSAC to address missed indicators in DPR area where the district received less than 80% of the eligible points to the NJDOE, as attached:

To approve that pursuant to 6A:23A-16.10(c)3, the School Business Administrator/Board Secretary certifies that the total encumbrances and expenditures for each line item does not exceed the line item appropriation in accordance with 6A:23A-16.10(a) as of March 31, 2018.
To approve that pursuant to 6A:23A-16.10(c)4, the Board of Education after review of the School Business Administrator/Board Secretary's and Treasurer of School Monies Reports as of March 31, 2018, and upon consultation with appropriate School District Officials, certifies that no fund has been over-expended in violation of 6A:23A-16.10(b), and that sufficient funds are available to the District Board of Education's financial operations for the remainder of the school year.
To approve a Resolution for Health Care Cost Adjustment for the 2018-2019 Budget year, as follows:
WHEREAS, in accordance with N.J.S.A. 18A:7F-38b a district can request use of Health Care Cost Adjustment only after it has fully exhausted all eligible statutory spending authority in the budget year; and
NOW THEREFORE BE IT RESOLVED that the Brick Township Board of Education has the need to utilize the Health Care Cost Adjustment for the 2018-2019 Budget of $1,344,084.
To approve a Resolution for the use of Banked CAP for the 2018-2019 Budget Year, as follows:
WHEREAS, in accordance with N.J.A.C. 6A:23A-10.1(b), a district can request use of banked cap only after it has fully exhausted all eligible statutory spending authority in the budget year; and
WHEREAS, banked cap from the earliest pre-budget year must be used before the amount from a more recent year;
NOW THEREFORE BE IT RESOLVED that the Brick Township Board of Education has the need to utilize Banked Cap for the 2018-2019 Budget and that $1,463,242 of the earliest pre-budget year unused Banked Cap spending authority shall be included in the 2018-2019 base budget.
BE IT FURTHER RESOLVED that the need for the Banked Cap utilization must be completed by the end of the 2018-2019 budget year and cannot be deferred or incrementally completed over a longer period of time.

To approve a Resolution to adopt a School District Budget for Fiscal Year 2018-2019, as listed:

WHEREAS, the Brick Township Board of Education recognizes school staff and Board Members will incur travel/training expenses related to and within the scope of their current responsibilities and for travel/training that promotes the delivery of instruction or furthers the efficient operation of the school district; and
WHEREAS, N.J.A.C. 6A;23A et seq requires Board Members to receive the approval of these expenses by a majority of the full voting membership of the Board and Staff Members to receive prior approval of these expenses by the Superintendent of Schools and a majority of the full voting membership of the Board; and
WHEREAS, a Board of Education may establish for regular district business travel only, an annual school threshold of $1,500 per staff member where prior Board approval shall not be required unless this annual threshold for a staff member is exceeded in a given school year (July 1 through June 30); and
NOW THEREFORE BE IT RESOLVED, the Board of Education approves all travel/training in compliance with N.J.A.C. 6A:23A et seq as being necessary and unavoidable; and
BE IT FURTHER RESOLVED, the Board of Education approves the tentative travel/training and related expense reimbursements in accordance with N.J.A.C. 6A:23A-7.3 to a maximum expenditure of $126,513 for all Staff and Board Members.
TRAVEL TRAINING
To approve Netta Architects as an additional Architect of Record for the 2017-2018 school year.
To approve a Fair and Open Resolution for a Provider of Architectural Services, as follows:
WHEREAS, there exists a need for a provider of Architectural Services for the Drum Point Elementary School Roof Project; and
WHEREAS, 18A:18A et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Board of Education by resolution at a public meeting; and
WHEREAS, 18A:18A-5 also states that Professional Services may be negotiated and awarded without public advertising for bids and bidding therefore; and
WHEREAS, 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract and that the resolution and contract are on file and available for inspection in the Office of the Board of Education; and
WHEREAS, 6A:23A-5.2(a)4 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.
NOW THEREFORE BE IT RESOLVED by the Brick Township Board of Education, as follows:
1. That Netta Architects be and is hereby appointed by the Brick Township Board of Education through construction and close out.
2. This appointment is made in accordance with the Request for Proposal dated April 12, 2018 as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional, licensed and regulated by law and meets requirements of N.J.S.A. 18A:18A-5.
3. This appointment is made in a Fair and Open process in accordance with N.J.S.A. 19A:44A-20.26.
4. The fee for services shall not exceed $26,437.

5. The duration of this appointment shall be from 12 months from this date.
6. A copy of Resolution shall be published in the Asbury Park Press as required by law within 20 days after its passage.
7. A certified copy of the Resolution, together with a copy of the proposal shall remain of file and be available for inspection.

5. The duration of this appointment shall be from 12 months from this date.

To authorize Netta Architects to amend the District's currently approved Long Range Facilities Plan and submit all required documents to the New Jersey Department of Education for approval as other capital projects with no state funding for the Veterans Memorial Middle School Auditorium HVAC Project, DOE Project #29-0530-090-18-2000.
To delegate the authority to the School District Business Administrator, James W. Edwards, Jr., CPA for the supervision of the School Facilities Project, DOE Project # 29-0530-060-18-1000, for the Midstreams Elementary School Exterior Door Project, on behalf of the Board of Education.
To authorize Netta Architects, the District Architect of Records to work on behalf of the District to prepare all plans, specifications, drawings and necessary bid related documents for DOE Project #29-0530-060-18-1000, for the Midstreams Elementary School Exterior Door Project, on behalf of the Board of Education.
To authorize Netta Architects to amend the District's currently approved Long Range Facilities Plan and submit all required documents to the New Jersey Department of Education for approval as other capital projects with no state funding for the Midstreams Elementary School Exterior Door Project, DOE Project #29-0530-060-18-1000.

To approve a Resolution authorizing the submission of a Bond Proposal or Proposals to the voters of the school district at the annual School District election scheduled for November 6, 2018, as follows: Updated 04/26/18
WHEREAS, The Board of Education of the Township of Brick in the County of Ocean, New Jersey (the "Board" when referring to the governing body, and the "School District" when referring to the territorial boundaries and the legal entity governed by the Board) is authorized to undertake renovations, improvements, and construction of new facilities as well as purchase the associated equipment and furniture necessary to provide a thorough and efficient education to the students of the School District; and
WHEREAS, the Board has conducted a thorough study of its facilities and equipment and has compared this information with student enrollment projections and other demographic information as it relates to the School District; and
WHEREAS, the Board now wishes to establish a date to request that the voters of the School District authorize the issuance of bonds to finance various improvements; and
WHEREAS, as a result of such study, the Board wants to authorize or ratify the preparation and submission of a school facilities project to the New Jersey Department of Education (the “Department of Education”) for the various improvements;
NOW, THEREFORE, BE IT RESOLVED by The Board of Education of the Township of Brick in the County of Ocean, New Jersey as follows:
Section 1. That a bond proposal or proposals be submitted to the voters of the School District at the annual election scheduled for November 6, 2018 for the purpose of authorizing the issuance of school bonds to finance various improvements throughout the School District.
Section 2. That the School Business Administrator/Board Secretary is authorized to notify the Clerk of the County of Ocean, the Ocean County Board of Elections and the Clerk of the Township of Brick (the “Township”) about the Board's intent.
Section 3. That the Board hereby authorizes, or hereby ratifies, the Superintendent of Schools, School Business Administrator/Board Secretary, architect, and bond counsel to submit school facilities project applications to the Department pursuant to the requirements of N.J.A.C. 6A:26-3.1 et seq. in order to determine the preliminary and final eligible costs under the Educational Facilities Construction and Financing Act (the “Act”) so that the Board can conduct a bond referendum to finance various capital improvements.
Section 4. That the Board hereby approves, if necessary, amendments to its long-range facilities plan in order to include the capital improvements being contemplated in the referendum and has elected to receive debt service aid under the Act.
Section 5. That the Board hereby approves or ratifies the conceptual schematic drawings of the various capital improvements to the School District’s facilities and hereby authorizes the submission of such schematic drawings to the planning board for its review and comment pursuant to N.J.S.A. 40:55D.
To approve a Fair and Open Resolution for a Provider of Pre-Referendum Services, as follows:
WHEREAS, there exists a need for a provider of Pre-Referendum Services for the Brick Township Board of Education; and
WHEREAS, 18A:18A et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Board of Education by resolution at a public meeting; and
WHEREAS, 18A:18A-5 also states that Professional Services may be negotiated and awarded without public advertising for bids and bidding therefore; and
WHEREAS, 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract and that the resolution and contract are on file and available for inspection in the Office of the Board of Education; and
WHEREAS, 6A:23A-5.2(a)4 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.
NOW THEREFORE BE IT RESOLVED by the Brick Township Board of Education, as follows:
1. That Netta Architects be and is hereby appointed by the Brick Township Board of Education.
2. This appointment is made in accordance with the request for proposal dated April 12, 2018 as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional, licensed and regulated by law and meets requirements of N.J.S.A. 18A:18A-5.
3. This appointment is made in a Fair and Open process in accordance with N.J.S.A. 19A:44A-20.26.
4. The fee for services shall not exceed $25,000.
NETTA PRE-REFERENDUM SERVICES PROPOSAL
5. The duration of this appointment shall be from 12 months from this date.
6. A copy of Resolution shall be published in the Asbury Park Press as required by law within 20 days after its passage.
7. A certified copy of the Resolution, together with a copy of the proposal shall remain of file and be available for inspection.
To approve to amend Legal Services, as follows:
WHEREAS, on June 1, 2017 the Board approved Montenegro, Thompson, Montenegro and Genz for Legal Services for the 2017-2018 school year for a total of 2,037 hours/$300,585 thru a Fair and Open process; and
WHEREAS to date less hours have been utilized than originally anticipated.
THEREFORE BE IT RESOLVED that the Board of Education approve hours to be used from May 1, 2018 thru June 30, 2018 not to exceed 275 hours/$39,875.
To approve a Fair and Open Resolution for a Provider of Legal Services for Special Education Matters, as follows:
WHEREAS, there exists a need for a provider of Legal Services Special Education Matters for the Brick Township Board of Education; and
WHEREAS, 18A:18A et seq requires any contract in which the amount exceeds the bid threshold be awarded by the Board of Education by resolution at a public meeting; and
WHEREAS, 18A:18A-5 also states that Professional Services may be negotiated and awarded without public advertising for bids and bidding therefore; and
WHEREAS, 18A:18A-5a(1) states that the Board of Education shall in each instance state supporting reasons for its action in the resolution awarding each contract and shall forthwith cause to be printed once in an official newspaper, a brief notice stating the nature, duration, service and amount of the contract and that the resolution and contract are on file and available for inspection in the Office of the Board of Education; and
WHEREAS, 6A:23A-5.2(a)4 states Professional Services contracts are to be issued in a deliberative and efficient manner such as through a Request for Proposal based on cost and other specified factors that ensures the District receives the highest quality services at a fair and competitive price.
NOW THEREFORE BE IT RESOLVED by the Brick Township Board of Education, as follows:
1. That Schwartz Edelstein Law Group be and is hereby appointed by the Brick Township Board of Education.
2. This appointment is made in accordance with the request for proposal dated February 23, 2018 as a Professional Service under the provisions of the Local Public Contract Law because the services are to be performed by a recognized professional, licensed and regulated by law and meets requirements of N.J.S.A. 18A:18A-5.
3. This appointment is made in a Fair and Open process in accordance with N.J.S.A. 19A:44A-20.26.
4. The fee for services shall not exceed 150 hours/$21,750.
