OPEN PUBLIC MEETINGS ACT NOTICE

The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Brick Township Board of Education has caused notice of this meeting to be posted on the Administration Office Bulletin Board, the official District website and Channel BTV-20, and sent to the Asbury Park Press, the Brick Times, the Star Ledger and Municipal Clerk's Office.

EXECUTIVE SESSION

RESOLUTION TO ENTER CLOSED SESSION

WHEREAS, the Brick Township Board of Education("Board") has been formed pursuant to applicable New Jersey statutes, and
WHEREAS, the Board is charged with the responsibility of performing all acts and doing all things consistent with law and the rules of the State Board of Education, necessary for the lawful and proper conduct, equipment and maintenance of the public schools and public school property of the Brick Township School District, and
WHEREAS, Section 7 of the Open Public Meetings Act (N.J.S.A. 10:4-12) permits the exclusion of the public ("Executive Session") from a meeting of the Board in certain circumstances, and
WHEREAS, the Board has determined that circumstances exist for such an Executive Session, and
WHEREAS, the Board has found the action described below to be necessary and proper,
NOW, THEREFORE BE IT RESOLVED by the Board on November 15, 2018 that:
    1. The public shall be excluded from discussion of and action on the Executive Session herein set forth.
    2. The session will be approximately thirty minutes and the general nature of the subject matter to be discussed is as follows:

    3. It is anticipated at this time that the above stated subject matter will be made public if and when it is deemed to be in the public interest to do so and the need for confidentiality is no longer required by the Board.

To approve that pursuant to 6A:23A-16.10(c)4, the Board of Education after review of the School Business Administrator/Board Secretary's and Treasurer of School Monies Reports as of September 30, 2018, and upon consultation with appropriate School District Officials, certifies that no fund has been over-expended in violation of 6A:23A-16.10(b), and that sufficient funds are available to the District Board of Education's financial operations for the remainder of the school year.

  11. To approve a Resolution for the filing of a Notice of Impasse with the Public Employment Relations Commission, as follows:
    WHEREAS, the Brick Township Board of Education ("Board") is a local board of education duly organized and existing under the laws of the State of New Jersey; and
    WHEREAS, the Brick Township Education Association ("Association") is the majority representative for classroom teachers, special education teachers, nurses, special services personnel, librarians, student service personnel, athletic trainers, attendance officers, instructional coach, teacher aides (classroom paraprofessionals), and teacher aides (verbal behavior paraprofessionals) (collectively "members") on matters affecting members terms and conditions of employment and is duly organized under the New Jersey Employer-Employee Relations Act (N.J.S.A. 34:13A-1 et seq.) and
    WHEREAS, on or about March 6, 2018, the Board and the Association submitted initial proposals to begin negotiations; and
    WHEREAS, the Board and the Association thereafter participated in negotiations on April 10, 2018, July 23, 2018, August 14, 2018, August 16, 2018, August 29, 2018, September 17, 2018, October 8, 2018 and October 15, 2018; and
    WHEREAS, the Board and the Association have been unable to come to terms despite good faith efforts to negotiate; and
    WHEREAS, the Board now finds that the Board and the Association have reached a negotiations impasse;
    NOW THEREFORE BE IT RESOLVED that the Board authorizes the Business Administrator/Board Secretary or his designee to file the Notice of Impasse and a certified copy of this resolution with the Public Employment Relations Commission ("PERC") immediately.
