OPEN PUBLIC MEETINGS ACT NOTICE

The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Brick Township Board of Education has caused notice of this meeting to be posted on the Administration Office Bulletin Board, the official District website and Channel BTV-20, and sent to the Asbury Park Press, the Brick Times, the Star Ledger and Municipal Clerk's Office.

EXECUTIVE SESSION

RESOLUTION TO ENTER CLOSED SESSION

WHEREAS, the Brick Township Board of Education("Board") has been formed pursuant to applicable New Jersey statutes, and
WHEREAS, the Board is charged with the responsibility of performing all acts and doing all things consistent with law and the rules of the State Board of Education, necessary for the lawful and proper conduct, equipment and maintenance of the public schools and public school property of the Brick Township School District, and
WHEREAS, Section 7 of the Open Public Meetings Act (N.J.S.A. 10:4-12) permits the exclusion of the public ("Executive Session") from a meeting of the Board in certain circumstances, and
WHEREAS, the Board has determined that circumstances exist for such an Executive Session, and
WHEREAS, the Board has found the action described below to be necessary and proper,
NOW, THEREFORE BE IT RESOLVED by the Board on October 15, 2019 that:
    1. The public shall be excluded from discussion of and action on the Executive Session herein set forth.
    2. The session will be approximately forty five minutes and the general nature of the subject matter to be discussed is as follows:

    3. It is anticipated at this time that the above stated subject matter will be made public if and when it is deemed to be in the public interest to do so and the need for confidentiality is no longer required by the Board.

  22. To approve a resolution requesting a legislative bill be introduced to make membership in New Jersey School Boards Association optional, as follows:
    WHEREAS,
    18A:6-45 requires all boards of education of the various school districts in New Jersey to be members of the New Jersey School Boards Association; and
    WHEREAS, the total cost to the Brick School District for membership and related fees and training is approximately $25,330 annually.
    NOW THEREFORE BE IT RESOLVED, the Brick Township Board of Education, in the County of Ocean, State of New Jersey, hereby requests that NJ Legislative District Ten sponsor a Bill that provides relief from the requirements of 18A:6-45 that all Boards of Education in New Jersey be members of the New Jersey School Boards Association, and allows such membership and related costs to be optional upon proper and timely notice.


  23. To approve the submission to the NJDOE by Educational Services Commission of New Jersey, Nonpublic Department to increase the number of students receiving Chapter 192 and 193 Services and the total amount of funding for those students for the 2019-2020 school year, as attached:

  24. To recommend authorization for the Business Administrator/Qualified Purchasing Agent to utilize a Competitive Contracting process for solicitation of a provider of Auction Marketing Services.


  25. To approve a Resolution for Third Party Reviewer of ESIP Services Provider, as follows:  Updated 10/14/19
    WHEREAS,
    there exists a need for a provider of a Third Party Reviewer of ESIP Services; and
    WHEREAS, this appointment is awarded as an Extraordinary Unspecifiable Service in accordance with the provisions of N.J.S.A. 18A:18A-5(2) as the services to be performed are specialized and qualitative in nature requiring expertise, extensive training and proven reputation in the field of endeavor; and
    NOW THEREFORE BE IT RESOLVED by the Brick Township Board of Education, as follows:
    1. That DLB Associates in accordance with their Competitive Contract response, be and is hereby appointed by the Brick Township Board of Education to said position.
    2. The fee for services shall not exceed $14,900.
    3. A copy of this Resolution shall be published in the Asbury Park Press as required by law within 20 days after its passage.
    4. A certified copy of this Resolution, together with a copy of the proposal shall remain on file and be available for inspection.
    5. The duration of this appointment shall be from October 16, 2019 thru December 31, 2019.


  26. To approve a Resolution authorizing contracts with certain approved State Contract Vendors, as follows:
    WHEREAS, the Brick Township Board of Education may by resolution and without advertising for bids, purchase any goods or services under the State of New Jersey Cooperative Purchasing Program for any State Contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of Treasury; and
    WHEREAS, the Brick Township Board of Education has the need on a timely basis to purchase goods or services utilizing State Contracts; and
    WHEREAS, the Brick Township Board of Education intends to enter into contracts with the attached referenced State Contract Vendors through this resolution and properly execute contracts which shall be subject to all the conditions applicable to the current State Contracts.
    NOW THEREFORE BE IT RESOLVED that the Brick Township Board of Education authorizes the Purchasing Agent to purchase certain goods or services from those approved New Jersey Contract Vendors on the attached list, pursuant to all conditions of the individual State Contract; and
    BE IT FURTHER RESOLVED that the duration of the contracts between the Brick Township Board of Education and the referenced State Contract Vendors shall be from October 16, 2019 through June 30, 2020.
