OPEN PUBLIC MEETINGS ACT NOTICE

The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interests is discussed or acted upon. In accordance with the provisions of this Act, the Brick Township Board of Education has caused notice of this meeting to be posted on the Administration Office Bulletin Board, the official District website and Channel BTV-20, and sent to the Asbury Park Press, the Brick Times, the Star Ledger and Municipal Clerk's Office.

PUBLIC COMENT

This will be the first opportunity for public comment and will be for agenda items only.  The Board invites thoughts and reactions on agenda items and items of concern from members of our community who are present.  Each participant is asked to give his or her name prior to making a statement.  All statements shall be directed to the presiding officer.  Comments shall be limited to five minutes and each speaker may only speak once.

  2. Board Secretary Administers Oath of Office to New Board Members

    I, _____________ do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution of the State of New Jersey, and that I will bear true faith and allegiance to the same and to the Governments established in the United States and this State, under the authority of the people, So help me God.

    I, _____________do solemnly swear (or affirm) that I posses the qualifications prescribed by law for the office of member of a board of education and that I will faithfully, impartially and justly perform all duties of that office according to the best of my ability, So help me God.


  3. Adoption of the Code of Ethics for School Board Members

    A school board member shall abide by the following Code of Ethics for School Board Members:

    a. I will uphold and enforce all laws, rules and regulations of the State Board of Education, and Court orders pertaining to schools.  Desired changes shall be brought about only through legal and ethical procedures.

    b. I will make decisions in terms of the Educational welfare of children and will seek to develop and maintain public schools that meet the individual needs of all children regardless of their ability, race, creed, sex or social standing.

    c. I will confine my board action to policy making, planning and appraisal and I will help to frame policies and plans only after the board has consulted those who will be affected by them.

    d. I will carry out my responsibility, not to administer the schools, but together with my fellow board members, to see that they are well run.

    e. I will recognize that authority rests with the board of education and will make no personal promises nor take any private action that may compromise the board.

    f. I will refuse to surrender my independent judgment to special interest or partisan political groups or to use the schools for personal gain or for the gain of friends.

    g. I will hold confidential all matters pertaining to the schools which, if disclosed would needlessly injure individuals or the schools.  In all other matters, I will provide accurate information and, in concert with my fellow board members interpret to the staff the aspirations of the community for its schools.

    h. I will vote to appoint the best qualified personnel available after consideration of the recommendation of the Chief Administrative Officer.

    i. I will support and protect school personnel in proper performance of their duties.

    j. I will refer all complaints to the chief administrative officer and will act on the complaints at public meetings only after failure of an administrative solution.


  4. Board Secretary Seeks Nomination for President.

    2020 BOARD OF EDUCATION MEETING DATES


  7. To adopt the Asbury Park Press as the official newspaper and the Brick Times and the Star Ledger as the alternate newspapers for the District, in accordance with N.J.S.A. 10:4-18.


  8. To authorize the personnel listed below to sign checks, effective from this date until the 2021 Reorganization Meeting, as follows:

    RESOLVED,
    the President, Board Secretary and Treasurer of School Monies be empowered to sign all checks, drafts, notes, acceptances, or other evidences of indebtedness of the Brick Township Board of Education, effective from this date until the 2021 Reorganization Meeting, and granting authority to have necessary signature plates made to be used to sign checks.
    RESOLVED, that the Principal, Assistant Principal, Board Secretary and/or Assistant Business Administrator be empowered to sign all checks for the high school and middle school Student Activities Account.  Each check shall require two (2) signatures.
    RESOLVED, that the Board Secretary and the Treasurer of School Monies be empowered to sign all checks for the District-Wide Payroll Agency Account.  Each check shall require two (2) signatures.


  9. To appoint Sean Cranston as the Appointing Authority.


  10. To appoint James W. Edwards, Jr., CPA as the District Public Agency Compliance Officer (PACO).
     

  11. BE IT RESOLVED, that the Superintendent of Schools and the Business Administrator/Board Secretary for the Brick Township Board of Education or their designee, be designated as the Board's agents to request State and Federal funds under the existing State and Federal Laws for the period from the date of this Reorganization Meeting to the Board Reorganization Meeting in the next calendar year.


  12. Adoption of all existing Board Policies and Regulations.


  13. TO APPROVE A RESOLUTION OF THE BRICK TOWNSHIP BOARD OF EDUCATION TO JOIN IN THE FILING OF AN OPEN PUBLIC RECORDS ACT REQUEST WITH, AND POSSIBLE FUTURE RELATED LITIGATION AGAINST, THE STATE OF NEW JERSEY CONCERNING THE CALCULATION AND ALLOCATION OF STATE AID
    WHEREAS, the School Funding Reform Act of 2008 (SFRA), N.J.S.A. 18A:7F-1 et seq., reflects the current New Jersey law that governs State Aid to public school districts; and
    WHEREAS, the State of New Jersey (State) has appropriated limited monies to fund such State Aid for public school districts; and
    WHEREAS, the State arbitrarily determines how much State Aid to allocate to each school district, without regard to district need or ability to pay; and 
    WHEREAS, the Brick School District is receiving substantially less State Aid than it otherwise should receive; and
    WHEREAS, such disparate treatment is neither “equal” nor “equitable” and is without a rational basis; and
    WHEREAS, the State should be transparent in how it calculates and allocates State Aid to each school district; and
    WHEREAS, to protect the interests of its school children, each school district is entitled to obtain data and records from the State as to how the State calculates and allocates State Aid to each school district; and
    WHEREAS, the Brick Township Board of Education believes that it is in the best interests of its residents, taxpayers, and school children to file an Open Public Records Act request with, and if needed, related litigation against, the State of New Jersey, Department of Education and the Commissioner of Education (and such other parties as may be appropriate) for data and records as to how the State calculates and allocates State Aid to each school district.
    NOW THEREFORE BE IT RESOLVED, that the Brick Township Board of Education hereby joins in the filing of the attached Open Public Records Act (OPRA) request at no cost to the Board; and
    BE IT FURTHER RESOLVED, that in the event the OPRA request is denied, the Board may join in the litigation against the State of New Jersey, Department of Education and the Commissioner of Education to obtain data and records from the State of New Jersey and its various Departments as to how the State calculates and allocates State Aid to each school district (OPRA Litigation); and
    BE IT FURTHER RESOLVED, that the Weiner Law Group, LLP is hereby appointed to represent the Brick Township Board of Education and all of the participating school districts in connection with the filing of the OPRA request and future OPRA Litigation against the State, if needed; and
    BE IT FURTHER RESOLVED, that in the event that the Brick Township Board of Education joins in the OPRA Litigation, the Board is hereby directed and authorized to provide whatever assistance is reasonably required in order to pursue such OPRA Litigation; and
    BE IT FURTHER RESOLVED, that in the event that the Brick Township Board of Education joins in the OPRA Litigation, the Board shall contribute $1,000.00 to support the filing of the OPRA Litigation pursuant to a retention letter to be executed by the parties.

  14. To approve a contract for Thomas G. Farrell as Superintendent of Schools, effective March 2, 2020 through June 30, 2024 (or earlier date upon early release, if granted) in the amount of $197,500, pro-rated for the 19-20 sy, $197,500 for the 20-21 sy, $202,931 for the 21-22 sy, $206,990 for the 22-23 sy and $211,130 for the 23-24 sy.
