IDENTIFICATION


The Board of Education of this District shall be known officially as the Board of Education of the Township of Brick in the County of Ocean. (18A:10-2).

The Brick Township School District is comprised of all the area within the municipal boundaries of the Township of Brick for the purpose of providing a program of education in grades Kindergarten through grade 12. (18A:8-1).

The Brick Township School District shall be classified Type II. (18A:9-3).

ROLE OF THE BOARD

The Board of Education is constituted, and governed by Title 18A of the New Jersey Statutes and the regulations adopted thereunder. The Board of Education will oversee the operation of the district through goal setting, policy development and evaluation, provide financial support for the educational and related programs, and fulfill such obligations as are imposed by law.

Powers

The Board of Education sees these as its required functions: 

    A. Legislative or Policymaking

      The Board is responsible for the development of policy and for the employment of a Superintendent who shall carry out its policies through the development and implementation of regulations. No policy of the district may be in conflict with the law nor may the Board adopt policies or perform any function expressly prohibited by law.
    B. Appraisal
      The Board is responsible for evaluating the effectiveness of its policies and their implementation.
    C. Educational Planning
      The Board is responsible for requiring and acquiring reliable information from responsible sources, which will enable it and the staff to work toward the continuing improvement of the educational program.
    D. Provisions of Financial Resources
      The Board is responsible for the adoption of a budget, which will provide the expenditures necessary for the successful operation of district buildings, the employment of staff, and the purchase of materials and equipment to enable the district to carry out its educational plan for the school year.

    E. Interpretation
      The Board is responsible for providing adequate and direct means for keeping the local community informed about the school district and for keeping itself and the school staff informed about the wishes of the public. All planning, whether budget related or not, needs to be communicated effectively to the public if citizens are to support the school program.

      The Board believes that by diligently exercising these functions it will be able to provide, within the financial limitations set by the community, the best educational opportunities possible for our children.

      The Board shall be responsible for the operation of the school district but shall delegate the administration to the Superintendent and the staff. Governing powers will be rigorously retained for action by the Board itself.

    EXECUTIVE AUTHORITY

    The Board of Education shall exercise its executive power in part by the appointment of a Superintendent as Chief School Administrator, who shall enforce the statutes of the State of New Jersey, the rules and regulations of the State Board of Education, and policies of this Board.

    The Superintendent shall prepare operating procedures needed for the administration of the school district that are consistent with statutes, rules and regulations of the State Board of Education and the policies of this Board. Operating procedures shall be binding upon the employees and pupils of this district when issued. The Board reserves the right to rescind any operating procedure.

    The Superintendent is delegated the authority to take necessary action in circumstances not governed by Board policy and shall report any substantial action to the Board.

    The Superintendent shall have a seat on the Board and shall have the right to speak on all matters at meetings of the Board, but shall have no vote.

The Board Secretary or designee is also authorized to express the Board's condolences to members of these groups who suffer the loss of a family member or to the family of employee, retired employee, or Board Member who dies.

      ROLE OF THE MEMBER
    A Board Member does not possess individually the authority and powers that reside in the Board of Education. No Board Member, by virtue of his/her office, or in an individual capacity, shall exercise any administrative responsibility with respect to the operation of the school district or command the services of any school district employee, vendor, or professional. The Board shall not be bound in any way by any action or statement on the part of any individual Board Member except when such statement or action is in pursuance of specific instructions from the Board.

    Board Members are entitled to full information and all data necessary for the proper performance of their duties and to which they are legally entitled. Special material requested by a Board Member(s) shall be made available to all members.

    Confidential information to which a Board Member becomes privy as a result of his or her office shall be used only for the purpose of helping the member discharge his or her responsibilities as a Board Member. No Board Member shall reveal information contained in a confidential record or received during a duly convened private session of the Board except when that information has been released to the public by the Board.

    Additional Responsibilities of Board Members

    The duties and obligations of an individual Board member may be enumerated as follows:
      1. Be familiar with state school laws, regulations of the New Jersey State Department of Education, district policies, rules and regulations.
      2. Take advantage of training opportunities that are offered locally and regionally for Board members.
      3. Have general knowledge of educational goals and objectives of the District.
      4. Work in harmony with other Board members.
      5. Share equally in the work of the Board.
      6. Vote and act impartially on all matters that come before the Board.
      7. Accept the will of the majority vote and give support to the resulting policy or action. This does not preclude a Board member from working to change the decision or policy through Board action.
      8. Represent the Board and the District to the public in a manner that promotes both interest and support.
      9. Refer all suggestions and complaints regarding schools, personnel, or activities to the Superintendent.

    Board members are entitled to express themselves publicly on any matter, including issues involving the Board and the school district. An individual Board member cannot, however, express the position of the Board, except as expressly authorized by the Board. A Board member shall not represent his/her personal opinions as the position of the Board and shall include in all formal expressions in which his/her Board affiliation is likely to be recognized, such as letters to government officials or newspapers, speeches to organizations, and the like, a statement that the opinion(s) expressed do not necessarily represent those of the Board.

    BRICK TOWNSHIP BOARD OF EDUCATION 



    BOARD SELF-EVALUATION

    The Board of Education is committed to the belief that every part of the school system in this district should be accountable to the public and that performance evaluation is essential to that accountability. The Board further believes that the improvement and growth of any institution depends upon an honest appraisal of its strengths and weaknesses. The Board accepts, therefore, responsibility for the conduct of a systematic program of self-evaluation and appraisal. The standards against which the Board will evaluate itself will be the educational goals, bylaws, and policies duly adopted by this Board.

    The Board will annually adopt an evaluation instrument that permits individual Board members to record their assessments of the conduct of Board meetings, the fiscal management of the district, the conduct of the instructional program, and the relationship of the Board with the Superintendent, other district staff members, and the community.

    The assessments of Board members will be tabulated and presented for discussion at a regular meeting of the Board in which the Superintendent will be invited to participate. The Board will formulate, as appropriate, goals and priorities that will serve to guide the Board in the ensuing school year.

    The annual evaluation shall be conducted at a time determined by the Board and shall include the following guidelines:

    1. A self-evaluation instrument shall be developed by the Board which provides for an individual analysis of the functioning of the Board as a whole and a self-analysis of the individual's own involvement in meeting his/her responsibilities as a Board member; and 

    2. A summary of the evaluation instrument shall be prepared; and

    3. A discussion of the summary results shall take place; and

    4. A committee appointed by the Board President shall compile a written summary of the Board discussion and may recommend to the Board specific areas for action and a determination of priorities. These actions shall be incorporated into the next year's evaluation.

    Filling Vacancies

    A vacancy due to resignation, death, or if a Board member ceases to be a resident of the District during a regular term, shall be filled by the Board, or by the County Superintendent, if such vacancy is not filled within sixty-five (65) days following its occurrence.

    Vacancies to be filled for reasons other than by resignation or death shall be according to law.

    In the event of the resignation or death of a serving Board member, the vacancy shall be filled within the statutory time limit by action of the Board as follows:

    a. Advertisement of the vacancy in suitable local media;

    b. Interviews with interested parties conducted by the Board as a whole;

    c. Recommendation by the Board acting as a committee of the whole;

    d. Appointment by the Board of the person adjudged most capable of filling the vacancy.

    The person appointed shall serve for a period in accordance with the law.

    Each member so appointed shall serve until the organizational meeting following the next annual election unless the appointment occurs within sixty (60) days immediately preceding such election to fill a term extending beyond such election. In the latter case, the appointed member shall serve until the organizational meeting following the second annual election next succeeding the occurrence of the vacancy.

    Officers and Auxiliary Personnel

    At the annual organization meeting of the Board of Education, the Board membership shall elect one of its members as president and another as vice-president, which officers shall serve for one year and until the next organizational meeting of the Board.

      Election and Duties of President

      At the annual organization meeting of the Board of Education, the Board shall elect one of its members as president and another as vice-president, which officers shall serve for one year and until the next organizational meeting of the Board.

      The president shall preside at all meetings of the Board and shall perform other duties as directed by statute, state department of education regulations, and this Board. In carrying out these responsibilities, the president shall:

      a. Sign the instruments, acts, and orders necessary to carry out state requirements and the will of the Board;
      b. Consult with the chief school administrator on the Board's agendas;
      c. Appoint Board committees and chairpersons;
      d. Call such meetings of the Board as he/she may deem necessary upon at least two days' notice in accordance with the provisions of the Open Public Meetings Act, N.J.S.A.10:4-6 et seq.;
      e. Be an ex officio member of all Board committees;
      f. Confer with the chief school administrator on crucial matters which may occur between Board meetings;
      g. Be responsible for the orderly conduct of all Board meetings.

      As presiding officer at all meetings of the Board, the president shall:

      a. Call the meeting to order at the appointed time;
      b. Announce the business to come before the Board in its proper order;
      c. Enforce the Board's policies relating to the order of business and the conduct of meetings;
      d. Recognize persons who desire to speak, and protect the speaker who has the floor from disturbance or interference;
      e. Explain what the effect of a motion would be if it is not clear to every member;
      f. Restrict discussion to the question when a motion is before the Board; 
      g. Answer all parliamentary inquiries, referring questions of law to the Board's attorney;
      h. Put motions to a vote, stating definitively and clearly the vote and result thereof.

      Vice President

      The vice-president shall assume and discharge the duties of the president in his absence, disability or disqualification.

      Vacancy in the Office of President or Vice-President

      In case the office of president or vice-president shall become vacant; the Board shall fill the vacancy at the next regular meeting or a special meeting of the Board by electing from its own membership.

      DUTIES OF BOARD SECRETARY

      The Board Secretary shall: 

      a. Give notice of all regular and special meetings (including the organization meeting) of the Board to the members. (18A:17-7) 

      b. Post and give notice of annual and special elections. (18A:17-7)

      c. Record the minutes of all procedures of the Board and the results of annual or special school elections. (18A:17-7) 

      d. Perform all necessary duties concerning School Board elections. (19:60-1 et. seq.)

      e. Collect tuition fees and other monies due the Board and transmit them to the Custodian of School Monies. (18A:17-8) 

      f. Examine and audit all accounts and demands against the Board, present them to the Board at its meetings, indicate the Board’s approval and send them to the Custodian for payment. (18A:17-8)

      g. Keep accounts of the school district’s financial transactions including a correct detailed account of all expenditures. (18A:17-8) 

      h. Report to the Board at one regular meeting the amount of the total appropriations and cash receipts for each account, the amount of warrants drawn against each account, and the amounts of orders or contractual obligations incurred and chargeable against each account. (18A:17-9)

      i. Keep all contracts, records and documents belonging to the Board. (18A:17-9) 

      j. Give the Board a detailed report of its financial transactions at the close of each fiscal year and file a copy with the County Superintendent. (18A:17-10) 

      k. Report to the Commissioner annually the amount of unpaid school debt, the interest rate payable, the dates of issue and the due dates of bonds and other indebtedness. (18A:17-12) 

      l. Prepare a summary of the annual audit and recommendations prior to the meeting of the Board to act thereon and supply copies of the summary to interested persons. (18A:23-4) 

      m. Purchase supplies when authorized by the Board. He/She must present an itemized bill with his/her affidavit attached for payment. (18A:18-7)

      n. Approve all contracts to be entered into by the district or any person on behalf of the district and act as authorized agent of the district and the Board in contracts between the district and other governmental agencies.

      o. Be responsible for recommending an adequate program of insurance in all phases of district operations with regard to those prescribed by law.

      p. Make proper reports to the Board, keeping the Board fully advised as to the financial status of the district and all the implications of the financial aspects of school administration.

      DUTIES OF THE TREASURER SCHOOL MONEYS

      The Treasurer of School Moneys is responsible to the Superintendent of Schools.

      The Treasurer of School Moneys shall: 

      a. Receive and hold in trust all school moneys, except funds from school athletic events and pupil organization activities and deposit them in the bank(s), which may include the State of New Jersey Cash Management Fund, designated by the Board. (18A:17-34) 

      b. Pay out school moneys only on warrants made payable to the person entitled to receive payment and specifying the object for which it is issued and signed by the President and Secretary of the Board and the Treasurer. (18A:19-1) 

      c. Receive school employee payrolls and a warrant for the full amount of each payroll certified by the President and Secretary of the Board, deposit the warrants in a separate payroll account, and issue individual checks drawn on such account to each employee. (18A:19-9, 10)

      d. Give public notice when funds are on hand for payment of interest bearing warrants issued for which no funds were available. (18A:19-12)

      LEGAL COUNSEL

      The legal counsel of the Board of Education shall be the legal adviser of the Board and its officers in questions related to their official duties. He/she shall attend all Board meetings, (and committee meetings when requested by the chairman), conferences, and shall fulfill such other legal duties as the Board may assign to him/her.       The auditor’s main duties shall be to make an annual audit, and act as a consultant to the Board on such additional financial matters as requested by the Board.

      Consultants

      The modern school system is a complex organization established to provide a high quality educational program for children, youth and adults who live in a changing and highly complex society. Additionally, the school system represents an investment of millions of dollars by the public for the cause of public education. In order to pursue its educational mission and also to protect the public’s financial investment in the schools, the Board will from time to time engage the services of qualified professional consultants to provide new insights and ideas for dealing with especially difficult problems, and/or to provide special services which present staff is unable to provide. Assistance sought from consultants may include, but not necessarily be limited to.

      1. Conducting fact-finding studies, surveys, and research.
      2. Providing counsel or services requiring special expertise.
      3. Assisting the Board in developing policy and program 
      Recommendations.

      Before engaging any consultant, the Board will require submission of a written proposal that can be incorporated into a contract or purchase order if it satisfies the wishes of the Board. Proposals will detail: 

      1. The specific objectives to be accomplished by the consultant.
      2. The specific tasks to be performed.
      3. The procedures to be used in carrying out the tasks.
      4. The target dates for the completion of tasks.
      5. The method to be used to report results to the Board and/or to 
      deliver any “product” (e.g. long-range plans, codified policy
      manual, etc.) to the Board.

      The Board will not contract for vague services such as undefined "management studies," and all proposals shall be submitted to the school legal counsel for review before a contract is let. The Board in consultation with the Superintendent will establish procedures necessary to affect an efficient working relationship between the consultant and the Board and/or staff members.

      COMMITTEES

       

      COMMITTEE OF THE WHOLE
      The Board meets as a  Committee of the Whole  to discuss matters of school concern and policy. In accordance with the provisions of the Open Public Meetings Act these meetings shall be open to the public.   The  schedule of  Committee  of  the  Whole  meetings  shall be determined at the annual  organizational  meetings  and the public shall be adequately notified.   No official action shall be taken at these meetings  unless so  noticed  according  to the Open Public Meetings Act. The President shall be the chairperson of the Committee of the Whole.


      ORGANIZATION AND ESTABLISHMENT OF COMMITTEES
      In order to use the time, effort, and expertise of its members most effectively, the Board operates under a committee system.   The  Board  reserves  the  right  to  meet  and work as committees in informational, discussion and exploratory sessions.   No   official  action  shall  be taken  at these meetings.

      STANDING COMMITTEES
      The Board president shall appoint  Board committees and committee chairpersons as soon after the organizational meeting as practical. Committees shall consist of no more than two members. The Board president shall serve as an ex-officio member on all committees and is notified of all committee meetings.

      Standing committees are established to improve the operations of the Board of Education by:

      1.      Providing opportunities for extensive informal discussion of issues, relevant facts, and alternative courses of action before they are taken up for formal consideration by the full Board.

      2.      Identifying, acquiring, and analyzing relevant data, recommendations (from internal and external sources), and advantages and disadvantages of proposed or possible courses of action, at greater length than would be possible at formal Board meetings.

      3.      Presenting clarifications of underlying issues, findings of fact, identification of alternatives to improve the efficiency of Board deliberations, the quality of Board decisions, and the level of public understanding of Board deliberations and actions.

      4.      Making specific recommendations, when appropriate, as to Board actions that might be taken.

      The standing committees of the Board and their duties are as follows

      1.      Curriculum and Instruction

      This committee will concern itself with the educational programs of the District, reviewing policies and programs in its areas of responsibility, and making recommendations to the Board of Education.

      2.      Human Resources

      This committee will concern itself with matters affecting employees of the Board of Education, reviewing policies on such matters as the qualification of employees, their remuneration, terms of service and other related matters, including procedures for evaluation of teachers and other employees, administrative structure, and management improvement.  The committee will make recommendations within the areas of its responsibility to the Board of Education.

      3.      Finance and Physical Plant

      This committee will make recommendations to the Board as necessary in the areas of finance, maintenance, transportation, and capital programs. 

      SPECIAL COMMITTEES

      Special committees may be created for special assignments.  The same rules shall apply to special committees as apply to standing committees, except that they shall be dissolved upon completion of their assignment.

      ORIENTATION AND TRAINING OF BOARD MEMBERS

      Orientation of New Board Members

      The superintendent shall prepare materials to introduce new Board members to the operating procedures of the district and the details of the curriculum. 

      Sufficient funds shall be allocated to reimburse new Board members for attending an NJSBA training program on the topic of superintendent evaluation within the first six months after taking office, and an NJSBA new Board member orientation within the first year of taking office.

      The New Jersey Administrative Code defines "newly elected or appointed Board member" as any Board member who has never served as a member of either an elected or appointed school Board.

      In-service Development

      State, regional and national workshops, conventions, conferences and seminars developed by associations such as the New Jersey School Boards Association, the National School Boards Association, the New Jersey Association of School Administrators provide unique opportunities for Board members to broaden their understanding of their responsibilities, learn new tools and techniques for coping with them, and keep up to date on educational trends.

      Therefore, the Board recommends that, in addition to sending the mandated delegates to the New Jersey School Boards Association's Delegate Assemblies, the Board send representatives to such educational conferences, workshops, conventions and seminars as it shall decide upon each year. 

      The same regulations regarding travel arrangements and reimbursement developed for other district-paid attendance at such events shall apply.

      The Superintendent shall prepare a checklist for district representatives to such events, to aid them in preparing meaningful reports for the Board and the district as a whole. The report shall be presented at a regular meeting of the Board within a month of the delegation's return.

                          Minutes
        The minutes of all meetings of the Board shall be sufficiently detailed to serve as documentation of Board compliance with New Jersey statutes and administrative code.

        The minutes of the meetings of the Board shall include:
            The classification (regular, adjourned or special), date, and place of the meeting;
            The call to order stating, time, person presiding and his/her office;
            The record of the roll call of Board members;
            A notation of the presence of the Superintendent, School Business Administrator, Board secretary, administrators and the public;
            Announcement of notification listing the newspapers by name;
            A record of any corrections to the minutes of the previous meetings and the action approving them;
            A record of all communications presented to the Board;
            A record of each motion placed before the Board, the result of the vote, and the vote of each member;

        A copy of the minutes of the previous meeting shall be sent to all Board members along with agenda materials.

        The minutes shall be filed permanently for reference purposes.

        All reports requiring Board action, resolutions, agreements and other written document shall be placed in the files of the Board secretary and or the superintendent as a permanent record.

        Public Access to Closed Meeting Minutes
        The minutes of closed session meetings of the Board must be made available to the public when the reason for confidentiality no longer exists. When a closed meeting deals with more than one privileged matter, the minutes shall be prepared in such a way that each matter can be separated and disclosed in a timely matter.

        Public Access to Regular Meeting Minutes
        Minutes of all regular meetings shall be available to the public for inspection within two weeks of the meeting.

        The minutes of the Board’s meetings shall be shown to the public upon request in the presence of the Board secretary or his or her designee. Requests for single copies of minutes as approved by Board at regular meetings shall be honored at the convenience of the Board secretary.

        The Board secretary shall tape record all public meetings of the Board in order to assure proper documentation of occurrences and the transcription of minutes. All tapes are the sole property of the Board and any individual requesting access to these materials must do so in writing.

        Tapes shall not be removed from the Board office and must be played in the presence of the Board secretary or his or her designee.

        All tapes shall be stored in a locked cabinet located in the Board office and shall be destroyed in accordance with the law.

        Any member of the public wishing to audio or video record a Board meeting shall give notice to the Board secretary prior to the meeting being recorded.

        Voting Method

        Official actions may be taken only at a regular monthly or specially called meeting of the Board at which a quorum is present. All motions shall require for adoption a majority of those present and voting (minimally a majority of the quorum) except as provided by code or statute.

        A vote can be conducted by voice or roll call, provided that the vote of each member is recorded, except where a recorded roll call majority is required by code or statute. Proxy voting is prohibited. Any member may request that the Board be polled.

        Abstentions

        A member may abstain from voting. An abstention shall be so recorded and shall not be counted as either an affirmative or a negative vote. Abstentions are to be so recorded, regardless of whether a person speaks for or against a motion prior to stating his or her wish to abstain. The silence of a member on any vote shall be recorded as an abstention.

        BOARD VOTING REQUIREMENTS

        The following actions require a recorded roll call vote and must pass by an affirmative vote of a majority of the full membership of the Board. “Full membership” means the number of Board members when all the members’ seats are filled. A “majority of the full membership” means a majority of that number. N.J.S.A. 18A:1-1.

        1. Directing the Board Secretary to make deductions for United States government bonds from salaries of participating employees (N.J.S.A. 18A:16-8).

        Endorsing approval of a lease purchase and authorizing the Chief School Administrator and/or Board secretary to advertise and solicit proposals in connection with a lease purchase, and to request state approval of a lease purchase of five years or less (N.J.A.C. 6A:26-10.3(h)). (Note that in this case, the two-thirds majority vote is required by administrative code provision. This is not a statutory requirement.)

          Endorsing approval of a lease of facilities in excess of five years and authorizing the Board of Education to request approval of an amendment to its long range facilities plan to reflect the leased facility (N.J.A.C. 6A:26-10.11 (c). (Note that in this case, the two-thirds majority vote is required by administrative code provision. This is not a statutory requirement.)

          The following actions require an affirmative vote of two thirds of the “authorized membership” of the school Board. “Authorized membership of the school Board” means the full membership of the district Board of Education as established pursuant to N.J.S.A. 18A:12.

            The following action requires an affirmative vote of three-quarters of the members present. It does not require a roll call vote.

            QUORUM

            A quorum shall consist of four Board members, and no business shall be conducted in the absence of a quorum, except when the Doctrine of Necessity is invoked. In the event a quorum is not present at the hour of convening, the meeting may be recessed to a time not later than 9:00 p.m. of the same day. If a quorum is not then present, the members present may adjourn the meeting to a later date within seven days.

            The Board recognizes that there may be matters that come before the Board or acts required of Board members in their official capacity where the Board member may have a conflict of interest or the act would be in violation of N.J.S.A. 18A:12-24. In these matters, the Board member(s) will remove himself/herself from any discussions, meetings (informal or formal), committee meetings, and/or a vote regarding the matter. The Board will consider this matter without the Board member(s) who has the conflict. In the event a matter comes before the Board or an act is required of a Board member in his/her official capacity that is a conflict or would be in violation of N.J.S.A.18A:12-24, the Board would still be required to have a quorum to consider the matter.

            The New Jersey Department of Education and the School Ethics Commission envisioned this prohibition could create a situation in which so many Board members have a conflict, that the Board would be unable to take action on a matter. Therefore, when more than a quorum of the Board members must abstain from voting on a matter, the Board will invoke the Doctrine of Necessity consistent with the New Jersey Department of Education and School Ethics Commission guidelines as follows:

            A. Board Member(s) in Conflict - Less Than a Majority of the Board

            1. In the event a Board member has a conflict of interest where the Board member will act in his/her official capacity, the Board member must remove himself/herself from any discussions, meetings (informal or formal), committee meetings, and/or a vote regarding the matter.

            2. In the event a Board member is unsure whether he/she or any other Board member has a conflict of interest or whether the matter, if acted upon by a Board member is in violation of N.J.S.A. 18A:12-24, the Board’s Legal Counsel will make a determination.

            3. The Legal Counsel for the Board will provide the Board of Education with an opinion on whether the matter is a conflict of interest or act prohibited by N.J.S.A. 18A:12-24.

            4. If a Board member believes he/she has a conflict of interest where he/she will act in his/her official capacity or if the Board‘s Legal Counsel renders an opinion that the Board member has a conflict of interest where the Board member will act in his/her official capacity, the Board member will remove himself/herself from any discussions, meetings (informal or formal), committee meetings, and/or a vote regarding the matter.

            B. A Majority of Board Members in Conflict

            1. In the event:
            a. A Board member believes he/she has a conflict of interest where he/she will act in his/her official capacity; or

            b. If the Board’s Legal Counsel renders an opinion that a Board member has a conflict of interest where the Board member will act in his/her official capacity; and

            c. The number of Board members that have a conflict would make it so that the Board would be unable to take action on the matter, then the Board may invoke the "Rule [or Doctrine] of Necessity." (U.S. v. Will, 449 U.S. 200 (1980)).

            C. Rule [Or Doctrine] Of Necessity

            1. The Doctrine of Necessity may be invoked when more than a quorum of the Board must abstain from voting on a matter.

            2. There are three pre-requisites necessary for a Board to invoke the Doctrine of Necessity:

            a. The Board must be unable to act without the members in conflict taking part; and

            b. There must be a pressing need for action, i.e. the matter cannot be laid aside until another date; and

            c. There can be no alternative forum that can grant the same relief. (Allen v.Toms River Regional Board of Education, 233 N.J.Super 651 (1989)).

            3. When the Board’s Legal Counsel advises the Board that the Doctrine of Necessity must be invoked in order to obtain a quorum on a vote, the Board must announce that it is invoking the Doctrine by the adoption of a resolution setting forth the invocation of the Doctrine of Necessity, the reason for doing so and the specific nature of the conflicts of interest. The resolution must be adopted and read at a regularly scheduled public meeting. A copy of the resolution must be posted by the Board, where it posts public notices for 30 days, and a copy of the resolution must be forwarded to the School Ethics Commission.

            4. When the Board announces the Doctrine of Necessity is being invoked, the details, parameters and other pertinent facts of the matter to be voted upon should be revealed on an agenda for the public meeting in which the matter is to be voted upon.

            5. The Board members who have a conflict in the matter are prohibited from:

            a. Participating in any discussions on the matter prior to the adoption of the resolution invoking the Doctrine of Necessity; and

            b. From entering an executive session in order to discuss the merits of the matter or contract; and

            c. From offering their opinions on the matter at any time prior to the adoption of a resolution invoking of the Doctrine of Necessity.

            6. After the Doctrine of Necessity has been invoked and thoroughly explained to the public, the Board members who have a conflict in the matter may participate only to the extent they may vote after a motion to approve and/or ratify the matter has been made and seconded.

            7. Board members in conflict may only ask questions regarding the matter to be voted on in public after the Board has invoked the Doctrine of Necessity.

            8. Board members in conflict may explain their reasons for not voting just before the vote.

            CONDUCT OF BOARD MEETING

            Parliamentary Authority

            Roberts' Rules of Order, Newly Revised, shall govern the Board of Education in its deliberations and acts in all cases in which it is not inconsistent with statutes of the State of New Jersey, rules of the State Board of Education, or these Bylaws.

            Presiding Officer

            The President shall preside at all meetings of the Board. In the absence, disability, or disqualification of the President, the Vice President shall act in his/her place; if neither person is present, the Board shall designate another member to preside by a plurality vote of those present.

            Announcement of Adequate Notice

            The person presiding shall commence each meeting with an announcement of the notice given for the meeting or a statement regarding the lack of quorum.

            Public and Executive Sessions

            The Board shall officially transact all business at a legal meeting of the Board in accordance with New Jersey law.

            All meetings of the Board shall be open to the public with the exception of meetings to discuss:

            A. Any matter which by express provision of state or federal law or rule of court shall be rendered confidential;

            B. Any matter in which the release of information would impair a right to receive federal funds;

            C. Any material, the disclosure of which constitutes an unwarranted invasion of individual privacy, unless the individual (or all of the individuals) concerned shall request in writing that the same be disclosed publicly. This includes information contained in pupil records, and any reports or recommendations concerning a specific individual;

            D. Any collective bargaining agreement or the terms and conditions which are proposed for inclusion in any collective bargaining agreement, including the actual negotiating sessions with representatives of employee groups;

            E. Any matter involving the purchase, lease or acquisition of real property (land or buildings) with public funds, where it could adversely affect the public interest if discussion of such matters were disclosed;

            F. The tactics and techniques used in protecting the safety and property of the public, provided that their disclosure could impair such protection;

            G. Any investigations of violations or possible violations of law;

            H. Any pending or anticipated litigation or contract negotiations other than collective bargaining, and any matters falling within the attorney-client privilege, to the extent that confidentiality is required in order for the attorney to exercise his/her ethical duties as a lawyer;

            I. Any matter involving employment, appointment, termination, terms and conditions of employment, evaluation, promotion or disciplining of any prospective or current public employee or officer unless all the individual employees whose rights could be adversely affected request in writing that the matter be discussed at a public meeting.

            J. Any deliberations occurring after a public hearing that may result in the imposition of a specified civil penalty or loss of license to an individual.


            Such sessions shall be closed to the public and press, and shall be declared so by a formal motion at a public meeting. Minutes taken at such meetings shall remain confidential only so long as their publication would defeat the purpose of the executive session. That such a meeting will be or was held shall be recorded in the minutes of the preceding or subsequent regular meeting. Board members and other persons attending the session are honor-bound not to disclose the topic or details of discussion at executive session.

            The Board may invite staff members or others to attend executive sessions at its discretion.

            No official action shall be taken at executive sessions, except such as may be sanctioned by law. To take final action on any other matter discussed, the Board shall convene or reconvene in open session.

            Public Participation

            Meetings of the Board are open to the public and all members of the community should feel free to attend. A time for public discussion of agenda items shall be included in the order of business at an appropriate time.

            Brief comments on any matter of interest to the district should be reserved for the time provided in the order of business.


            Provision may be made for the introduction by a member of the public of business not on the agenda when the matter is of such urgency or wide interest that delaying consideration of it to the next meeting would not be in the public interest.

            The Board shall not consider grievances or complaints that have not previously been considered through administrative channels.

            MEETINGS

            Organization Meeting

            The Board of Education shall organize annually, at a date and time, specified by law, at which time, newly elected members shall take office.

            During its organization meeting, the Board shall elect one of its members as president and another as vice-president; officially select a depository and custodian of school moneys; appoint a secretary to the Board and an auditor; make such other appointments as it deems in the best interest of the Board; and establish the time and place of Board meetings for the ensuring year.

            The Board of Education shall at the organizational meeting:

            1. Designate one or more depositories for school funds, N.J.S.A. 18A:17-34;
            2. Designate those persons authorized to sign school warrants, N.J.S.A. 18A:19-1;
            3. Designate the official newspaper, N.J.S.A. 18A:22-11; 18A:39-3;
            4. Designate a second newspaper for the publication of Board meetings, N.J.S.A. 10:4-8;
            5. Designate the day, place, and time for regular meetings of the Board
            6. Approve the curriculum for all grades;
            7. Readopt existing Bylaws and policies for the Board's operation and the operation of the school system.
            The Board may conduct such other business as it deems desirable.

            Regular Meetings
            The time and place of the regular business meetings of the Board shall be established at the organization meeting. The Board shall conduct its business in public in accordance with the provisions of the New Jersey Open Public Meetings Act. The Board shall consider and act upon matters within its authority as prescribed by the statutes, the rules and regulations of the state Board of Education.

            Public Participation

            Meetings of the Board are open to the public and all members of the community are encouraged to attend. The Board recognizes the value of public comment on educational issues and the importance of allowing members of the public to express themselves on matters of community interest. The Board will accordingly permit members of the public to review all Board meeting agendas at the Board office prior to all regularly scheduled Board agenda meetings.

            A time for public discussion of agenda items shall be included in the order of business. Additional time for public comments on any matter of interest to the District shall also be included after the Board has acted on the entire agenda.

            The Board President shall call for public comments after district administrators have presented the agenda item and Board members have exhausted their initial questions. When no member of the public wishes to be heard, the President shall close the public comment portion on the agenda item and shall entertain no additional public comment on that item.

            At meetings other than agenda and regular meetings, members of the public will be invited to comment on issues before the Board. Public comment will follow any presentation on the issue offered by district administrators and any questions posed by Board members. At the beginning of any such meeting, the Board President will announce the manner in which public comment will be entertained.

            At any meeting of the Board, public comment shall be governed by the following rules:

              A participant must be recognized by the presiding officer and must state his or her name, address, and group affiliation if appropriate for the record.
              Participants shall direct all statements to the presiding officer; no participant may address or question Board members individually.
              Any participant wishing to address the Board shall be given the opportunity provided his/her remarks are relevant to the subject being considered and provided he or she does not become personal or abusive. It shall be the responsibility of the presiding officer to place any restriction on the time that may be allotted to a speaker.
              The Board shall not consider grievances or complaints that have not previously been considered through administrative channels.
              No participant may speak more than once on the same topic unless all others who wish to speak on that topic have been heard.

            The presiding officer may:
              Interrupt, warn, or terminate a participant’s statement when the statement is too lengthy, duplicative, personally directed, abusive, obscene or irrelevant;
              Request any individual to leave the meeting when that person does not observe reasonable decorum;
              Request the assistance of law enforcement officers in the removal of a disorderly person when that person’s conduct interferes with the order and progress of the meetings;
              Call for a recess or an adjournment to another time when the lack of public decorum so interferes with orderly conduct of the meeting as to warrant such action;
              Waive these rules when necessary for the protection of privacy or the efficient administration of the Board’s business.
            Meetings

            Special Meetings

            Special meetings of the Board shall be held whenever called by the president or upon the signed petition of a majority of the whole number of members of the Board.

            Special meetings of the Board shall be held in public in accordance with the provisions of the New Jersey Open Public Meetings Act. The notice and purpose of all special meetings shall be given to all Board members and the public as required by the provisions of the Open Public Meetings Act. At such meetings only the business for which the meeting was called shall be in order. No public discussion shall be heard on items other than those related to the purpose or purposes of the meeting.

            Adjourned Meetings

            An adjourned meeting is the continuation of the meeting from which there was an adjournment. At the adjourned meeting the business interrupted by the adjournment motion is the first order of business after the reading of the minutes.

            Agenda Meetings

            Agenda meetings may be held prior to each regular meeting of this Board to decide on items that will be placed on the agenda for the regular meeting. Agenda meetings are subject to the provisions of the Open Public Meetings Act.

            SUSPENSION OF POLICIES, BYLAWS AND REGULATIONS

            The Board of Education has developed a careful and deliberate process of formulating and adopting its policies and Bylaws. Requests for suspension of any existing policy or Bylaw should receive the same careful consideration.

            Therefore:

            a. Any request for a waiver of policy or Bylaw shall be considered in light of the policy or Bylaw itself, rather than any particular circumstances of the moment.

            b. The Board shall decide whether the policy or Bylaw still reflects the considered intent of the Board. If it does, the suspension will be denied and the policy or Bylaw reaffirmed in the minutes.

            c. If the policy or Bylaw does not reflect the intent of the Board, then the policy shall be waived by a majority vote of the members of the Board present and voting and development of a revised policy or Bylaw shall become the Board's prime policy priority.

            In the event of an emergency requiring immediate action, the Chief School Administrator shall have the power to waive policy or regulation in the single instance. In such cases, the Chief School Administrator shall report the instance to the Board president immediately, and request reconsideration of the policy at the next regular meeting of the Board.

            FORMULATION, ADOPTION, AMENDMENT OF ADMINISTRATIVE REGULATIONS

            The Board of Education delegates to the Superintendent the function of specifying required actions and designing the detailed procedures under which the school will be operated. Such rules and detailed procedures shall constitute the administrative regulations governing the schools.

            These administrative rules and regulations must be consistent with Board contracts and policies, the laws, rulings of the Commissioner, and rules of the State Board of Education.

            In the development of rules, regulations, and procedures for the operation of the school system, the Superintendent shall include at the planning stage, whenever appropriate, those employees who will be affected by such provisions.

            Such rules and regulations shall be binding on all employees unless or until the Board should vote to change or rescind any such rule or regulation following its presentation at a public meeting of the Board. The Board itself will adopt administrative regulations when specific state laws require Board adoption, and may do so when the Superintendent recommends Board adoption. The Board reserves the right to review and cause revisions of administrative regulations should they, in the Board's judgment, be inconsistent with the policies adopted by the Board.

            FORMULATION, ADOPTION, AMENDMENT OF BYLAWS

             

            The Board of Education's Bylaws are rules designed to organize and control its internal operations. Some Bylaws are set by statute. Others may be formulated and adopted at its option by the Board itself as long as they are in harmony with the intent and specifics of the statutes.

            In its deliberations leading to the establishment or amendment of its Bylaws, the Board's central concern will be for increased efficiency and effectiveness in carrying out its legally mandated tasks.

            Proposed new Bylaws and suggested amendments to or revisions of existing Bylaws shall be adopted by a majority vote of the members of the Board present and voting during the second of two regularly or specially scheduled meetings of the Board. The proposed additions, amendments or revisions shall have been described in writing in the agendas for these meetings.

            FORMULATION, ADOPTION, AMENDMENT OF POLICIES

            The governance of the district through policies directed toward providing a thorough and efficient education for its pupils is one of the most important functions of the Board of Education. Therefore, the Board shall establish a careful process to ensure:

            A. Development of clear, workable, legal policies which reflect mature consideration of the will and needs of the community, and

            B. Timely, accurate evaluation of the effectiveness of the policies in the achievement of district objectives and progress toward goals.

            In order to ensure that the total policy process is implemented effectively, the Board appoints the Superintendent, or his/her designee, as policy coordinator. In cooperation with the Board, procedures to implement this Bylaw shall be established to include an action plan for the rational development of policies and their regular review; appropriate policy goal-setting; a process for evaluation of district and school progress toward or achievement of policy goals; and appropriate standards of measurement and criteria for judging such progress.

            The schedule for regular and continuous review is as follows:

            METHODS OF OPERATION

            The Board of Education is directly responsible to the people in providing a means of effective and efficient public education. To that extent, it shall be the purpose of the Board to provide an organization through which the adopted policies may be executed efficiently.

            Three functional activities are recognized in respect to policies of the Board:

            1. Legislative - Planning is basic to all activity. It is that function which makes policies, selects an executive, and delegates to the executive the placing of plans and policies into operation, and provides the financial means for their execution.

            2. Executive - The executive function is concerned with the placing into operation the plans and policies, keeping the Board of education informed, and furnishing creative leadership to the Board of Education and to the profession.

            3. Appraisal - Appraisal is the function which attempts, through careful examination and study of the facts and conditions, to determine the (a) efficiency of operation of the general activities, and (b) the worth and value of results of the activities in relation to the efficiency and value of instruction.

            The Board of Education reserves to itself the legislative and appraisal functions, and shall make periodically such appraisal. The executive function shall be completely delegated to the Superintendent of Schools. The Superintendent shall be completely responsible for devising ways and means for executing efficiently the policies adopted by the Board of Education.

            SCHOOL BOARD USE OF ELECTRONIC COMMUNICATIONS

            Use of electronic communications by Board members shall conform to the same standards of judgment, propriety and ethics as other forms of school Board-related communication. Electronic communications should not be used to discuss, deliberate, or build consensus concerning any matters that require public discussion under the Open Public Meetings Act.

            Electronic communications include but are not limited to electronic mail (e-mail), Internet Web forums, Instant Messaging (IM), Internet chat rooms, FAX and conference calls.

            Board members shall comply with the following guidelines when using electronic communications in the conduct of Board responsibilities;

            A. Board members shall not use e-mail as a substitute for deliberations at Board meetings or for other communications or business properly confined to Board meetings.

            B. Board members shall not make any reference to confidential information about employees, students or other matters in e-mail communications because of the risk of improper disclosure. Board members shall comply with the same standards as school employees with regard to confidential information.

            Under the Open Public Meetings Act, deliberation by a quorum of members constitutes a meeting. Deliberation is defined as movement toward a decision including but not limited to the sharing of an opinion regarding business over which the Board or committee has supervision, control, jurisdiction, or advisory power. A quorum may be arrived at sequentially by using electronic communications without the knowledge and intent by the author.

            Examples of appropriate uses of electronic communications:

            - The dissemination of factual information by a Board member to any number of Board members by one-way distribution (no discussion).
            - The dissemination of information by a Board member to any number of Board members and the return of information that is NOT a matter or matters over which the Board has supervision, control, jurisdiction, or advisory power.
            - Acceptable forms of information to be returned.
            - Housekeeping information such as availability of meeting dates and time; and
            - requesting or communicating agenda items.
            - Examples of inappropriate use of electronic communications regarding any matter or matters over which the Board or a Board committee has supervision, control, jurisdiction, or advisory power.
            - Discussion of such matters even though the number of school Board members involved does not constitute a quorum.
            - Forwarding of a school Board member's comments to another school Board member on such matters.
            - Polling of Board members by administration or a Board member regarding any such matters.

            CONFLICT OF INTEREST

            The Board of Education accepts the responsibility of governing the operation of the district in the best interests of the total community. Individual members all subscribe to the philosophy and guidelines for action in Policy 9270 Code of Ethics. The Board as a body, and the members individually, wish at all times to avoid attitudes and actions that might give rise to public questioning of the integrity of any Board decision.

            For the purpose of this Policy, “immediate family member” shall be defined as the spouse or dependent child of a Board member residing in the same household.

            Therefore, in addition to complying with all statutory requirements:

            A. No Board member shall hold any form of paid employment with the district while he/she is serving, nor for one year after leaving office.

            B. No Board member shall discuss or vote on a proposed collective bargaining agreement with a bargaining unit; participate in any way as a member of the negotiating team; be present in closed session when the Board is discussing negotiation strategies nor participate in negotiations in any way when an immediate family member belongs to that bargaining unit.

            C. No Board member shall discuss or vote on a proposed collective bargaining agreement with a bargaining unit; participate in any way as a member of the negotiating team; be present in closed session when the Board is discussing negotiation strategies nor participate in negotiations in any way, when he/she or an immediate family member belongs to the same statewide general union with which the school Board is negotiating.

            D. No Board member shall use, attempt to use, or allow to be used any property owned or leased by the school district for the purpose of securing financial gain for the Board member, an immediate family member, a political organization, or a business in which the Board member or an immediate family member has an interest or which employs or provides compensation to the Board member or an immediate family member.

            E. No Board member shall use, attempt to use, or allow to be used his/her position for the purpose of securing financial gain for the Board member, an immediate family member, a political organization, or a business in which the Board member or an immediate family member has an interest or which employs or provides compensation to the Board member or immediate family member.

            F. No Board member shall use, attempt to use, or allow to be used any information which is not generally available to the public, and which the Board member acquired by reason of his/her position, for the purpose of securing financial gain for the Board member, an immediate family member, a political organization, or a business in which the Board member or an immediate family member has an interest or which employs or provides compensation to the Board member or an immediate family member.

            G. No Board member shall solicit, accept, or agree to accept, either directly or indirectly, any gift, loan, political contribution, service, promise of future employment, or other thing of value if the Board member knows or reasonably should know that the gift, loan, political contribution, service, promise of future employment, or other thing of value was given or offered for the purpose of influencing the Board member, directly or indirectly, in the discharge of his/her duties.

            H. No Board member shall knowingly direct or request that any person or business which is a party to a contract with the school district perform, whether for compensation or not, any services for, or contribute anything of value to a political organization as defined in N.J.S.A. 18A:12-23.

            I. No Board member shall knowingly direct or request that any other school official or any person employed by the school district or any club or organization related to or associated with the school district, such as a parent teachers association or athletic club, perform, whether for compensation or not, any services for, or contribute anything of value to, a political organization as defined in N.J.S.A. 18A:12-23.

            J. No Board member shall participate in any way in school district action which he/she knows or reasonably should know would result in the payment of school district funds, from whatever source derived, to the Board member, an immediate family member, a political organization, or a business in which the Board member or an immediate family member has an interest or which employs or provides compensation to the Board member or an immediate family member.

            K. Nothing in this Policy shall be construed to prohibit a Board member from taking action in an official capacity if by reason of that action no benefit or detriment could reasonably be expected to accrue to the Board member or an immediate family member as a member of a group to any greater extent than any such benefit or detriment could reasonably be expected to accrue to any other member of such group.

            L. No Board member, immediate family member, or business in which a Board member or immediate family member has an interest, or which employs or provides compensation to the Board member or immediate family member, shall knowingly perform any services for compensation for, sell anything of value to, or do business in any manner with the school district or any club or organization related to or associated with the school district, such as a parent teachers association or athletic club.

            M. No Board member shall serve as mayor or as a member of the municipal governing body of the district.

            CODE OF ETHICS

            The members of the Board of Education recognize that they hold authority not as individuals but as members of the Board. In order to make a clear public statement of its philosophy of service to the pupils of the district, the Board adopts this code of ethics.

            A. I will uphold and enforce all laws, New Jersey State Board of Education rules and regulations, and court orders pertaining to schools. Desired changes should be brought about only through legal and ethical procedures.
            B. I will make decisions in terms of the educational welfare of children and will seek to develop and maintain public schools which meet the individual needs of all children regardless of their ability, race, creed, sex or social standing.
            C. I will confine my Board action to policymaking, planning and appraisal and I will help to frame policies and plans only after the Board has consulted those who will be affected by them.
            D. I will behave toward my fellow Board members with the respect due their office--demonstrating courtesy, decorum and fair play at all public meetings and in all public statements.
            E. I will refrain from inappropriate conduct in public meetings and in making public statements, refraining from any disparagement of my fellow Board members or others on a personal, social, racial or religious basis.
            F. I will carry out my responsibility, not to administer the schools, but, together with my fellow Board members, to see that they are well run.
            G. I will recognize that authority rests with the Board of Education and will make no personal promises nor take any private action which may compromise the Board.
            H. I will refuse to surrender my independent judgment to special interest or partisan political groups or to use the schools for personal gain or for the gain of friends.
            I. I will hold confidential all matters pertaining to the schools which, if disclosed, would needlessly injure individuals or the schools. But in all other matters, I will provide accurate information and, in concert with my fellow Board members, interpret to the staff the aspirations of the community for its schools.
            J. I will vote to appoint the best qualified personnel available after consideration of the recommendation of the chief school administrator.
            K. I will support and protect school personnel in proper performance of their duties.
            L. I will refer all complaints to the Chief School Administrator and will act on such complaints at public meetings only after failure of an administrative solution.

            EXPENSES AND REIMBURSEMENTS

            Board members receive no payment for their services. With Board approval, they may be reimbursed for out-of-pocket expenses incurred on Board business.

            Travel and Related Expenses

            Travel reimbursement will be paid only upon compliance with the Board’s policy provisions and approval requirements. Board members, trustees and employees shall only be reimbursed for work-related travel that is directly related to and within the scope of the Board member’s, trustee’s and employee’s current work responsibilities. Board members, trustees and employees shall only be reimbursed for travel that:

                A. Promotes the delivery of instruction and is critical to the instructional needs of the school district or furthers the efficient operation of the school district,

            B. Is educationally necessary and fiscally prudent, and

                C. Is directly related to and within the scope of the Board member’s current responsibilities, and for school district employees, the school district's professional development plan.

            As described in this policy, school district travel expenditures include, but are not limited to, all costs for transportation, meals, lodging, and registration or conference fees to and for the travel event. School district travel expenditures include costs for all required training and all travel authorized in existing school district employee contracts and school Board policies. This includes, but is not limited to, required professional development and other staff training, required training for new school Board members, and attendance at specific conferences authorized in existing employee contracts.

            Travel Payments

            Travel payments will be paid only upon compliance with the school Board's policy provisions and approval requirements. The Board of Education will not ratify or approve payments or reimbursements for travel after completion of the travel event. All Board members, trustees and employees shall adhere to the following specifications to be considered for reimbursement:

                A. Reimbursement may not exceed State travel reimbursement guidelines as established by the NJ Department of Treasury in NJOMB circular letters, including but not limited to the types of travel, methods of transportation, mileage allowance, meal allowance, overnight travel and supporting documentation.
                B. Reimbursement must also be in compliance with OMB Circular A-87 (found at http://www.whitehouse.gov/omb/circulars/a087/a87_2004.html). No reimbursement will be issued without submission of written documentation such as receipts, checks and vouchers detailing the amount of each expenditure. Such documentation must be submitted within a timeframe to be established by the Board.
                C. Travel expenditures must be in compliance with state travel payment guidelines as established by the Department of the Treasury and with guidelines established by the federal Office of Management and Budget; except that those guidelines that conflict with the provisions of Title 18A of the New Jersey Statutes shall not be applicable, including, but not limited to, the authority to issue travel charge cards. The Board of education shall comply with the applicable restrictions and requirements set forth in the State and federal guidelines including, but not limited to, types of travel, methods of transportation, mileage allowance, subsistence allowance, and submission of supporting documentation including receipts, checks or vouchers.
                D. Board members, trustees and employees shall provide within one week, a brief report that includes, as appropriate, but may not be limited to, a description of the primary purpose for the travel, and a summary of the goals and key issues that were addressed at the event and their relevance to improving instruction or the operation of the school district. This report will be submitted to the Board secretary or other appropriate party designated by the Board.
                E. Pursuant to N.J.A.C. 6A:23A-5.8 concerning out-of state and high-cost travel events, out-of-state travel shall be limited to the fewest number of Board members or employees needed to present the content at the conclusion of the event. Lodging may only be provided if the event occurs on two or more consecutive days and where home-to-event commute exceeds 50 miles. Prior written approval of the executive county superintendent is required when the travel event has a total cost that exceeds $5000.

            In addition to the requirements above, employee travel, to be reimbursable, must be directly related to the employee’s professional development. No district employee shall be reimbursed for travel and related expenses without prior written approval of the Superintendent and prior approval by a majority of the full voting membership of the Board (as set forth below).

            Prior Approval is Required

            Board members shall only be reimbursed for travel and related expenses that have received prior approval by a majority of the full voting membership of the Board, and are in compliance with N.J.S.A. 18A:12-24 and 24.1 of the School Ethics Act.

                A. Specifically, a Board member must recuse himself from voting on travel if the Board member, a member of his immediate family, or a business organization in which he has an interest, has a direct or indirect financial involvement that may reasonably be expected to impair his objectivity or independence of judgment.
                B. Also, a Board member shall not: act in his official capacity in any matter in which he or a member of his immediate family has a personal involvement that is or creates some benefit to the school official or member of his immediate family; or undertake any employment or service, whether compensated or not, which may reasonably be expected to prejudice his independence of judgment in the execution of his official duties.
                C. For employees, the Board requires that travel occur only upon prior written approval of the Superintendent and prior approval by a majority of the full voting membership of the Board.
                D. For Board members, travel may occur only upon prior approval by a majority of the full voting membership of the Board and that the travel be in compliance with section 4 of P.L.1991, c.393

            (C.18A:12-24) and section 5 of P.L.2001, c.178 (C.18A:12-24.1).

            Travel Advances are Banned

            An employee of the school Board, a school Board member, or organization, shall not receive an amount for travel and travel-related expenses in advance of the travel, pursuant to N.J.S.A.18A:19-1 et seq.

            Annual Maximum Travel Expenditure Amount

            The Board of Education shall:

                A. Allot in its annual budget a maximum travel expenditure amount and annually review its policy to assure that it properly reflects the amount budgeted.
                B. Vote to authorize each reimbursement; specifying the way in which it promotes the delivery of instruction or furthers the efficient operation of the school district, within the maximum annual amount.
                C. Annually in the pre-budget year, establish by school Board resolution, a maximum travel expenditure amount for the budget year, which the school district shall not exceed in that budget year. The school Board resolution shall also include the maximum amount established for the pre-budget year and the amount spent to date.
                D. Provide that the maximum school district travel expenditure amount shall include all travel in accordance with this policy supported by local and State funds.

            Additional Detailed Accounting Requirements which Demonstrate Compliance

            In order to demonstrate compliance with this policy, documentation of all reimbursed travel expenses shall be maintained on file. This record may include receipts, checks and vouchers submitted in connection with any reimbursement. The district shall maintain separate accounting for school district travel expenditures as necessary, to ensure compliance with the school district’s maximum travel expenditure amount. This may include, but need not be limited to, a separate or offline accounting of such expenditures or expanding the school district’s accounting system. The tracking system shall be sufficient to demonstrate compliance with the Board’s policy and this section, and shall provide auditable information.

            To minimize travel expenditures, school Boards and staff will take the following steps:

                A. “Retreats” will be held at school district facilities, if available. A retreat is a meeting of school district employees and school Board members, held away from the normal work environment, at which organizational goals and objectives are discussed.
                B. A school district shall not bare costs for car rentals, limousine services, and chauffeuring costs to or during the event, as well as costs for employee attendance for coordinating other attendee accommodations at the travel event.
                C. One-day trips that do not involve overnight lodging are not eligible for a subsistence payment or reimbursement except in limited circumstances authorized in Department of the Treasury guidelines.
                D. Overnight travel is eligible for a subsistence payment or reimbursement as authorized in Department of the Treasury guidelines, except as otherwise superseded by the following:
                    1. Per diem payment or reimbursement for lodging and meals will be actual reasonable costs, not to exceed the federal per diem rates as established in the federal register for the current year;
                    2. Lodging expenses may exceed the federal per diem rates if the hotel is the site of the convention, conference, seminar or meeting and the going rate of the hotel is in excess of the federal per diem rates. If the hotel at the site of the convention, conference, seminar, or meeting is no longer available, lodging may be paid for similar accommodations at a rate not to exceed the hotel rate for the event;
                    3. Receipts are required for hotel expenses. Meal expenses under the federal per diem allowance limits do not require receipts;
                    4. In any case in which the total per diem reimbursement is greater than the federal per diem rate, except when the going rate for lodging at the site of the convention or meeting exceeds federal per diem rates, the costs will be considered to be excessive and shall not be paid by school district funds;
                    5. School districts shall patronize hotels and motels that offer special rates to government employees unless alternative lodging offers greater cost benefits; and
                    6. Payment or reimbursement is approved for the full cost of an official convention meal that the employee or school Board member attends, when the meal is scheduled as an integral part of the convention or conference proceedings. If a meal is included in the registration fee, the allowance for the meal is not eligible for reimbursement.

            Blanket or general pre-approval for travel is not authorized and will not be permitted by the Board. Specifically, approval shall be itemized by event, event total cost, a number of employees and school Board members attending the event. However a school Board may also approve, at any time prior to the event, travel for multiple months as long as the school Board approval, as detailed in school Board minutes, itemizes the approval by event, total cost, number of employees and school Board members attending the event.

            Types of Expenditures Not Eligible for Reimbursement

            Unnecessary and excessive travel expenditures as listed in N.J.A.C. 6A:23A:7.8 are prohibited. Prohibited types of expenditures include: travel by spouses and other relatives; costs for unnecessary employee attendance ( for example employees who merely coordinate other attendees’ accommodations at the travel event); charges for laundry, valet service and entertainment; district payment for alcoholic beverages; excessive tipping and gratuities; airfare without documentation of at least three (3) price quotes; and souvenirs.

            Penalties

            The Board by this policy informs its members and staff that the penalties for violating this policy based on state law includes:

                A. By law, any district Board of education that violates its established maximum travel expenditure, or that otherwise is not in compliance with the travel limitations set forth in this section may be subject to sanctions by the commissioner as authorized pursuant to N.J.S.A.18A:4-23 and N.J.S.A.18A:4-24, including reduction of State aid in an amount equal to any excess expenditure.
                B. A person who approves any travel in violation of the school district’s policy or this section shall be required to reimburse the school district in an amount equal to three times the cost associated with attending the event.
                C. An employee or member of the Board of education who travels in violation of the school district’s policy or this section shall be required to reimburse the school district in an amount equal to three times the cost associated with attending the event.

            The Superintendent may develop regulations to implement this policy.

            RESIGNATION/REMOVAL FROM OFFICE


            Whenever a member shall cease to be a bona fide resident of the district his membership shall immediately cease. Any member who fails to attend three consecutive regular or special meetings of the Board without good cause may be removed from office upon action duly proposed at a meeting of the Board and passed by a majority vote of the whole Board at the next meeting.

            POLICY No. 9223 BRICK TOWNSHIP BOARD OF EDUCATION


            AGENDA PREPARATION/ADVANCE DELIVERY
            OF MEETING MATERIALS

            The Chief School Administrator and the Board President shall prepare the agenda for all meetings of the Board. In doing so, they shall consult the Board Secretary.

            Items of business suggested by any Board member, staff member, or citizen of the District many be included at the discretion of the Chief School Administrator and Board president. When appropriate, the agenda shall allow time for the remarks of citizens, staff members, or pupils who wish to speak briefly before the Board.

            The agenda shall be published pursuant to provisions of the Open Public Meetings Act. The Board shall follow the order of business set up by the agenda unless the order is altered by a majority vote of the members present and voting. At a regularly scheduled meeting for which an advance agenda has been provided to the public, items of business not anticipated at the time the agenda was prepared may be discussed and acted upon if a majority of the Board present and voting agrees to consider them. However, existing Board policies and bylaws may not be revised or new ones adopted unless the proposals are on the written agenda.

            The agenda, together with supporting materials, shall be distributed to Board members sufficiently prior to the Board meeting to permit them to give items of business careful consideration. The agenda shall also be made available to the press, representatives of community and staff groups, and others, upon request.

              Board of Education Records

              Records of the Board shall constitute public records and, as such, shall be available in the office of the Board Secretary for inspection by the public in accordance with the provisions of the Open Public Records Act,

              The Secretary of the Board shall keep such records as may be required by law. All such records including minutes and the annual statement of the auditors shall be public documents, open for inspection by the public at the office of the secretary of the Board during the regular working hours in accordance with the provisions of the Open Public Records Act,


              Limitations

              No portion of the records of the district as they pertain to employees or pupils shall be public records except as provided by law.

              No working papers, internal memoranda or other documents generated by members of the Board of education or members of the staff of the district shall be public documents or open to inspection by the public except upon specific approval of the Board and as required by law.

              POLICY No. 9220 BRICK TOWNSHIP BOARD OF EDUCATION



              ELECTION


              The Board of Education consists of seven (7) members elected for three (3) year terms. The annual election shall be held on the third Tuesday in April, unless another date is designated by the Commissioner of Education in accordance with N.J.S.A. 19:60-1. Members are chosen for a term of three (3) years from candidates who have filed the necessary petition with the secretary of the Board. A Board member may succeed himself/herself.
